Toby's Estate Coffee Roasters: Sponsor a ‘Toby’ Sydney Marathon 2026

1. Information on how to enter, and prizes, form part of these Terms & Conditions. Any entry not complying with these Terms and Conditions is invalid.
    

2. The Promoter is Toby's Estate Coffee Pty Limited (ABN 86 084 104 423), 32-36 City Road, Chippendale New South Wales 2008. The Promoter can be contacted via email at social@tobysestate.com.au or phone 1300 074 178.
    

3. Entry is open to natural persons who are residents of Australia and living in Australia, aged 18 and over (“Eligible Entrant”).
    

4. The entry period for the promotion commences at 01 July 2026 and closes at 11.59pm AEST on 19 July 2026 (“Promotion Period”).
    

5. To be eligible to enter, Entrants must, during the Promotion Period, meet these requirements:

   1. First name is Toby or similar e.g. Tobi, Tobias, (it is up to the discretion of the promoter on the variation of name allowed)

   2. Must be signed up to run in the Sydney Marathon 2026

   3. Agree to be filmed and named in content for Marketing purposes
       

6. Entries are deemed to be received at the time and on the date that they are received by the Promoter.
    

7. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrants that do not meet the requirements.
    

8. This is a game of skill. Up to three (3) winners will be selected by the Promoter's internal judging panel based on their submission and a screening call to confirm they satisfy all eligibility criteria and campaign requirements.
    

9. Up to three (3) winners will be selected. If fewer than three (3) eligible entries meet the Promoter's requirements, the Promoter may select one (1), two (2), or no winners.
    

10. Winners must continue to meet these Terms and Conditions and any campaign requirements throughout the Promotion & campaign period including and up to the marathon date. Subject to compliance, each winner will receive one (1) recovery prize pack valued at $4677.55.

12. The winners will be picked on 21 July 2026 at 32-36 City Road, Chippendale NSW. And contacted by email/phone on 22 July 2026. If any of the Winners cannot be contacted or do not claim their prize within 4 days, the winner will be redrawn and notified.

13. No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability, and the Promoter reserves the right to substitute any prize with another of equivalent value without giving notice, subject to regulatory approval.

14. The Promoter accepts no responsibility for any tax implications that may arise from the prize. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s guidance.

15. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.

16. Each entry becomes the property of the Promoter. All personal information will be collected and stored by the Promoter in accordance with the Privacy Act 1988. All entrants have the right to access their personal information and request correction of any errors pursuant to the Privacy Act 1988.

17. By entering this competition, the Entrant agrees to receive marketing from the Promoter in relation to the competition.

18. The Promoter’s decision is final, and no correspondence will be entered into.

19. The Promoter reserves the right to vary these Terms and Conditions or to modify, suspend, terminate or reschedule the Promotion, subject to regulatory approval.

20. By entering the promotion, the entrants agree that the Promoter can publish his or her name and region on Toby’s Estate channels. The Promoter may use his or her name, image, and/or photograph/s, or videos for publicity and promotion purposes, without compensation, and agrees that the Promoter will own copyright in any such images, videos and photograph/s and in all material incorporating the images and/or photograph/s.

21. The Winners may be required to sign a release in a form determined in the absolute discretion of the Promoter (or, where relevant, a prize provider).

23. By entering this competition, the Entrant is indicating their acceptance and agreement to be bound by these terms and conditions.
